Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Cooling-off period: the period during which the consumer may exercise their right of withdrawal.
- Consumer: the natural person who is not acting for purposes related to their trade, business, craft, or profession and enters into a distance contract with the entrepreneur.
- Day: calendar day.
- Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period.
- Entrepreneur: the legal entity offering products and/or services to consumers at a distance, in this case Belavie.
- Distance contract: an agreement concluded between the entrepreneur and the consumer within the scope of an organized distance sales system, using only remote communication techniques until and including the moment of the agreement.
- Means of distance communication: any method that can be used to enter into a contract without the consumer and entrepreneur being together in the same place.
Article 2 – Applicability
1. These terms and conditions apply as of October 4, 2024.
2. They apply to every offer made by Belavie and to every distance agreement concluded between Belavie and the consumer.
3. Before the distance contract is concluded, these terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed prior to conclusion that the terms can be reviewed at Belavie’s request and will be sent free of charge.
4. If additional product or service terms apply, the consumer may rely on the most favorable applicable condition in case of conflicting clauses.
Article 3 – The Offer
1. If an offer has a limited validity or is subject to conditions, this will be clearly stated.
2. The offer includes a complete and accurate description of the products and/or services. Any obvious errors or mistakes do not bind Belavie.
3. The offer provides all necessary information to inform the consumer of their rights and obligations.
4. Before completing a purchase, the consumer is informed about the return process, withdrawal timeframe, the fact that the return address is in China, and potential associated costs. This information is clearly stated in the return policy and these terms.
5. Products are shipped directly from international suppliers, without a domestic warehouse. Delivery times may vary depending on supplier and destination.
Article 4 – The Agreement
1. The agreement is concluded when the consumer accepts the offer and meets the stated conditions.
2. If accepted electronically, Belavie will confirm receipt without delay.
3. Belavie implements appropriate security measures for data transmission and maintains a secure online environment.
4. Belavie may verify the consumer’s ability to fulfill payment obligations. If there is a valid reason not to proceed, Belavie may reject or attach special conditions to the order.
Article 5 – Right of Withdrawal
1. Due to automated shipping, orders can only be canceled within 1 hour after being placed. After that, the order is processed and cannot be stopped. Consumers can still withdraw after receiving the product under the following terms:
2. The consumer may withdraw from the purchase within 30 days without giving a reason.
3. The withdrawal period begins the day after the product is received. During this time, the consumer must handle the product with care and only use it as necessary to assess whether they wish to keep it.
4. If withdrawal is exercised, the product and all accessories should be returned in original condition and packaging, according to the instructions provided by Belavie.
5. Returns must be sent to the designated return address in China. Due to our international logistics model, returns are only processed at this location.
6. Return shipping costs are the responsibility of the consumer. These may be high due to international logistics.
7. A restocking and handling fee of $10 per item will be applied to returned items to help cover processing costs.
8. Belavie is an international seller and is not registered or operating as a U.S. domestic retailer. Therefore, U.S.-specific federal or state return laws may not apply. Belavie adheres to its own clearly stated return policy as agreed upon at the time of purchase.
Article 6 – Costs of Withdrawal
1. Belavie will refund the paid amount, including any shipping costs, as soon as possible and no later than 30 days after withdrawal, provided the product is returned in good condition.
2. Return shipping costs are the responsibility of the customer, unless otherwise agreed.
This also applies to items shipped directly from international suppliers.
Article 7 – Exclusion of the Right of Withdrawal
Belavie may exclude the following items from withdrawal rights, provided this is clearly stated:
- Products made to the consumer’s specifications
- Personalized items
- Items that cannot be returned due to their nature
- Sealed items that are not suitable for return due to hygiene or health reasons, if the seal has been broken
- Items with broken tags
- Certain discounted items or promotions may be marked as “Final Sale”, “Seasonal Sale” or “Clearance Sale” and are therefore not eligible for return or refund.
Article 8 – Price, Customs & Taxes
1. Prices listed do not include VAT.
2. Belavie reserves the right to adjust prices. Any changes will not apply to already placed orders.
3. Depending on supplier and customer location, no VAT may apply. Any additional fees such as import duties or customs taxes are the customer’s responsibility. These costs are not covered or reimbursed by Belavie.
4. Customers must comply with their country’s import regulations.
5. Belavie provides required shipping documents but cannot guarantee compliance with local import laws.
6. Belavie acts as an intermediary and never takes legal ownership of products. Therefore, VAT is not charged on behalf of Belavie.
7. Belavie does not collect U.S. state sales tax. It is the buyer’s responsibility to report any applicable use tax according to their state’s laws.
Article 9 – Conformity and Warranty
1. Defective or incorrect items must be reported within 5 days of delivery with clear photo evidence. As this is a clearance sale, no warranties or exchanges apply. Returns will not be accepted.
2. Belavie ensures that products conform to their descriptions and are fit for normal use.
Any manufacturer warranties are subject to the original manufacturer's terms and must be claimed directly with the manufacturer. Belavie does not facilitate warranty claims.
Article 10 – CESOP Compliance
As of 2024, payment service providers report transactions to the EU’s CESOP (Central Electronic System of Payment Information). Belavie complies with this regulation, which may impact the monitoring and reporting of transactions.
Article 11 – Delivery and Fulfillment
1. Orders will be delivered to the address provided by the consumer.
2. Belavie aims to ship orders within 30 days, unless otherwise agreed.
3. Delays or partial shipments will be communicated within this 30-day window.
4. Failure to comply with import requirements by the consumer does not justify cancellation or refund.
5. All import-related duties are the responsibility of the customer.
6. All products are shipped from our international fulfillment centers. Average delivery times range from 6–12 business days. Customs processing times may vary and increase the total delivery time.
6. If a package is not collected and returned to sender, Belavie will only process it upon actual receipt. If the return is lost or undelivered, no refund will be issued.
7. Tracking and timely pickup are the customer’s responsibility. If the pickup window expires, the order is considered delivered.
Article 12 – Payment
All payments must be made within 7 days of the agreement, unless otherwise specified.
If incorrect payment details are submitted, the customer must notify Belavie immediately.
Article 13 – Complaints Procedure
Complaints must be submitted clearly and in detail within 7 days of identifying the issue.
If resolution is not possible by mutual agreement, the dispute may proceed to legal channels.
Belavie responds to complaints within 14 days of receipt.
Article 14 – Disputes
1. All agreements are governed exclusively by United States law, even for international customers.
2. Consumers are responsible for complying with local import rules and paying all related costs.
3. Disputes will preferably be resolved in consultation but may be brought before a competent court in the United States of America.
Article 15 – Additional or Deviating Provisions
1. Any additions or deviations must not disadvantage the consumer and must be confirmed in writing.
2. Belavie reserves the right to terminate communication or services in cases of threats, impersonation of authorities, harassment, or abuse of return rights. Legal action may be taken under Dutch criminal law if necessary.
Article 16 – Limitation of Liability
To the fullest extent permitted by applicable law, Belavie shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use any product purchased from this site. In no event shall Belavie’s total liability exceed the amount paid by the customer for the product.
Legal notice
This site is operated by Belavie. All purchases are governed by these Terms and Conditions and subject to the laws of the United States. Any legal disputes shall be resolved under U.S. jurisdiction unless otherwise required by international consumer law.
